Comment Of Senator Patrick Leahy (D-Vt.),
Ranking Member, Senate Judiciary Committee,
On Partisan Attacks Of The Federal Judiciary

June 6, 2016

“Last week, the Republican Party’s presidential nominee made the outrageous and baseless accusation of bias against a Federal judge, based on his ethnic heritage. Anyone who cares about our independent Federal judiciary should be deeply troubled by these dangerous comments, which threaten to undermine the legitimacy of our justice system and of any judge or judicial nominee with a diverse background. I am proud of the fact that there are more women and minorities serving on our Federal bench than ever before, including Judge Curiel. This dedicated and respected public servant literally risked his life as a Federal prosecutor when he prosecuted violent drug dealers from a Mexican cartel. Instead of attacking Judge Curiel’s integrity based on his heritage, we should be honored that he has continued to serve his country. Judge Curiel, who was born in Indiana, is as much an American citizen as anyone in this body. His steadfast and patriotic service stands in sharp contrast to the Republican standard bearer who is attacking him.

“This latest attack on the independence of the judiciary is made worse when coupled with Senate Republicans’ obstruction of the pending Supreme Court nominee, which also threatens to harm the functioning of our system of checks and balances.  Instead of diminishing our independent Federal judiciary, we must do all we can to support it.”
