Comment Of Senator Patrick Leahy (D-Vt.), Ranking Member, Senate Judiciary Committee, On D.C. Circuit Court of Appeals Decision in al Bahlul v. United States

[Senate Judiciary Committee Ranking Member Patrick Leahy (D-Vt.) issued the following comment Friday after the D.C. Circuit held that conspiracy charges cannot be tried in a military commission because conspiracy is not a war crime.]


“The D.C. Circuit’s decision in the al Bahlul case underscores what so many of us have been saying for years:  America stands on stronger legal and moral ground when we use our Federal courts to try terrorists for their crimes.  The Justice Department has successfully tried hundreds of terrorism crimes since September 11, including conspiracy and material support, and holds the individuals convicted of those crimes in federal prisons.  We are not afraid of terrorists, nor are we afraid to bring them to justice in our courts.  Today’s decision is on the right side of history for our legal system, and for our values as a nation.”
